K3 Visa
The K-3 Visa is a multiple-entry Non-Immigrant Visa which allows your Filipino spouse to stay with you in the United States. However, K-3 Visa holders still have to file for Adjustment of Status in order to become a Lawful Permanent Resident of the USA. You may also take your spouse’s children with you to the United States by filing an application for a K-4 derivative visa.
US Tourist Visa
The US Tourist Visa is granted to people who want to visit the United States for a certain limited period of time for the purpose of business (B-1), holiday (B-2), or medical treatment (B-2). The applicant must show valid ties to the Philippines to be eligible for approval of this visa status.
If you want your spouse to be a Lawful Permanent Resident of the United States and enjoy the same immigration benefits, he/ she must file for Adjustment of Status in order to secure an immigrant visa without having to leave the USA.
If your Filipino spouse intends to be able to work immediately upon arrival in the USA, it would be best to file an application for a CR-1 Visa. This Conditional Resident status would enable them to receive the same benefits as that of a Permanent Resident of the United States. The conditional status can be lifted before the end of your spouse’s second year as a conditional resident.
