In order for a petition for an inter-country adoption to be approved in the Philippines, the foreigner, or the former Philippine citizen now permanently residing abroad must prove that the adoption of the minor Filipino child is in the best interest of the latter. The law prefers the foreign applicants to be married, but emphasizes that the application of single applicants are also accepted. It must be stressed, however, that the latter application shall be placed in the lowest priority.
Although Philippine law prohibits divorce, the Family Code of the Philippines allows divorce between a foreigner and the Filipino spouse. The citizenship of either of the spouses is immaterial at the celebration of the marriage. Under the law, as long as one of the spouses is a foreign citizen at the time of the divorce, even if by mere naturalization, such divorce shall be considered as valid.
