Who may avail of the Italian “family member visa”

If the immediate family members of an Italian citizen are living abroad, they may finally be united with their loved one based in Italy by availing of the “Italian family member visa.”
Aside from Italian citizens the law allows the same visa to be availed of by a foreign citizen with residence permit, or foreign citizens who are holders of a work visa for subordinate employment, or foreign citizens who are holders of visas for self-employment, for study or for religious reasons.
Under the second option, the resident must have already obtained a Permit to Stay or Permesso, before the application for the visa may be filed with the appropriate government agency.

The immediate family members are the:
a.Spouse
b.Children below twenty-one years of age
c.Parents of the spouse of an Italian citizen or
d.Both the parents of the spouses, if the Italian resident is not an Italian citizen

Requirements

1.Duly accomplished visa application form
2.Recent passport size photo
3.Passport or travel document valid for at least three (3) months after the expiration date that will be indicated in the visa
4.“Nulla Osta” (entry clearance) which was issued within six (6) months earlier by the competent “sportello unico” (Unified Immigration Desk)
5.If the child is a minor, a written permission from the other parent is required under the law to be presented to immigration authorities before the visa may be issued
6.Marriage Certificate duly registered by the Legalization Section of the Consulate General of Italy
7.Attestation of age issued by the National Population Commission duly legalized by the Legalization Section of the Consulate General of Italy (for spouse and parents)
Under the present law, the Italian embassy or consulate abroad is not authorized to issue the visa being applied for unless the local Italian police authorities issue an authorization clearing the resident of any prior criminal records.

Where to submit

The foregoing requirements, together with the duly accomplished application form must be submitted by the applicant at the Italian Embassy operating in the country where such applicant resides.
Upon payment of the corresponding non-refundable visa fee, the applicant may be required to undergo an interview with the Embassy officials based on the discretion of the latter.
