
How long is the validity of the K-1 Visa?

The K-1 Visa will be in effect for ninety (90) days upon your fiance/e’s arrival in the United States, during which you will have to get married or he/ she will have to go back to the Philippines after the validity period of the visa has expired.
If I am divorced, can I still file for a K1 Visa application?
You will still be able to apply for a K-1 visa even if you are divorced as long as you are able to present a copy of your divorce certificate along with other evidence supporting the fact that you are legally able to marry.

Only citizens of the United States of America are eligible to file a petition for the K-1 Visa.
Can my fiancée leave the USA during the 90-day validity of the K-1 Visa?
Your fiancée cannot leave the USA until after you get married, and until you apply for an adjustment of status, which is the first step towards becoming a lawful permanent resident of the United States. However, if you wish to leave the country after getting married, you need to apply for advanced parole which may take around 90 days before it can be obtained.
